Delray Beach moves to charge developers its own impact fees

Delray Beach is preparing to charge developers a new layer of municipal impact fees, and a consultant study sitting on this week’s agenda spells out exactly how much every new house, hotel room and commercial foot would owe the city.

Why it matters

Impact fees are a direct line item in the pro forma, and Palm Beach County already levies its own. What the study proposes is a second, city-level charge on top of that, covering administration, police, fire, parks, water, sewer and stormwater. For a developer deciding where in South Florida to put the next project, this is the kind of cost that quietly moves a deal one municipal border over.

The timing is the tell. The city is weighing these fees the same week its own redevelopment agency concedes it cannot get anyone to build affordable housing on its land. The CRA’s RFP to sell a vacant lot at 216 NW 8th Avenue for a single workforce home drew zero bids and was cancelled in April, with the non-profit builders it consulted pointing straight at construction costs on small, non-conforming lots. Adding fees to that math cuts the same direction.

The numbers

Prepared by consultant DTA and dated January 28, the study sets the maximum defensible fees. Residential lands at $1.39 per square foot for city administration, $0.61 for police and $1.22 for fire, roughly $3.22 combined, plus $562.50 per unit for parks, the ceiling Florida’s HB 337 allows for 2026. On the study’s own average new unit of 2,202 square feet, that is about $7,100 before parks and before water, sewer and stormwater.

Commercial land uses carry more: retail at $5.39 per square foot across the same three categories, office at $2.70. A hotel room runs about $2,555. Stormwater alone is $24,036 per acre, and residential sewer is $1,000 per single-family connection.

What’s next

The study is a ceiling, not the adopted number, and Florida law caps how fast fees can rise once set. Developers with entitlements in Delray should model the full stack now and, if a project is close, get vested before adoption. Track the market on the South Florida hub.
