Miami's cottage housing rule would legalize the 2,500 sq ft lot
The by-right path unlocks existing non-conforming small lots that already met the dimensions on May 1, 2026. The sewer connection decides which of them pencil.
Miami’s City Commission takes second reading Thursday on an ordinance that would allow a single-family house on a 2,500 sq ft lot as narrow as 25 ft. It does not add units per lot, it adds lots.
Why it matters
The lot supply question is the whole story for builders. File 19427 creates two qualifying paths. The first is a T3-O lot inside a TOD area or transit corridor with sewer available that meets the new standards. The second, the one worth mapping, is any existing T3 lot that already met the cottage lot standards as of May 1, 2026, with sewer available and no TOD requirement. That path is by right, no entitlement process, which turns a stock of non-conforming small lots into buildable product overnight. Density is explicitly unchanged: one principal building and one dwelling unit per lot. There is no affordability requirement, no bonus FAR and no height bonus, so the pro forma is a straight single-family sale in a South Florida market where entry-level lots are the constraint.
The numbers
Lot width runs 25 ft to 35 ft, lot area 2,500 sq ft to 5,000 sq ft, with lot coverage capped at 50%. Front and rear setbacks are 20 ft. The side setback drops to 3 ft, and an ancillary building sits at 3 ft to the side and rear. Covered parking is capped at 12 ft wide on principal frontage and 24 ft on secondary; driveways at 12 ft and 20 ft. Front-setback pavement is limited to 60% of the area and 40% impervious. Each lot needs at least two trees, one of them in the front setback. Parapets may reach 6.5 ft with a third layer below the second story.
What’s next
Two definitional changes decide whether a house actually fits. In T3, porticos and porches in the first and second layers would no longer count toward lot coverage, and encroachments are rewritten: porticos and porches at least 3 ft deep may encroach 50% of the front setback, up from 6 ft, and open porches at least 6 ft deep may encroach 8 ft. The stated purpose is to discourage the box house. The cost gate is the mandatory sewer connection, which will sort which lots pencil. The item passed first reading 5-0 on July 9, sponsored by Mayor Eileen Higgins with Commissioner Rolando Escalona and Chair Christine King, after a Planning, Zoning and Appeals Board recommendation of approval.
