NYC's Rent Freeze Still Starts Oct. 1 as a Judge Opens City Hall Email
A discovery order is not a ruling on the merits, and the October rent roll on roughly 1 million stabilized apartments has not moved.
A New York State Supreme Court justice has ordered limited discovery of written communications between mayoral personnel and the Rent Guidelines Board in the landlord challenge to the first rent freeze in the board’s history. Justice Brendan Lantry issued the order Sept. 16. He has not ruled on the merits, and the 0 percent guideline still takes effect Oct. 1 on roughly 1 million rent-stabilized apartments.
For an owner underwriting stabilized stock, nothing about the October rent roll changes this week. The one thing that could move that date is a merits ruling the court has not made.
Why it matters
Discovery in an Article 78 special proceeding is unusual, and Lantry said so in the order: “The court acknowledges that discovery in a special proceeding is rare.” What he authorized is tightly drawn. It covers written communications between mayor’s office personnel and board personnel from Jan. 1 through June 25, 2026. Messages internal to City Hall and messages internal to the board were excluded. The petitioners, a group of rent-stabilized owners represented by attorney Randy Mastro, allege the board’s process was steered from City Hall. That is their claim, not a finding by the court. This ruling changes the odds that a documentary record gets built, not the rent roll. Underwrite the freeze as live for the full lease year and treat any reversal as upside you have not paid for.
The numbers
Per the board’s own Apartment and Loft Order #58, adopted June 25, 2026, the guideline is 0 percent for both one-year and two-year renewals on leases commencing Oct. 1, 2026 through Sept. 30, 2027. The prior year’s Order #57 set 3 percent and 4.5 percent. The vote was 7 to 1. The gap that matters to a pro forma is what the unregulated half of the market is doing: New York metro asking rents were up 4.5 percent year over year in July, to about $3,627 a month, on our read of the Zillow Observed Rent Index, and Manhattan’s median rent hit a record $5,295 in June with vacancy under 1.5 percent, as we reported. A stabilized building holding at 0 percent while taxes, insurance and payroll move with that market is where the NOI gap opens.
What’s next
The landlords must submit their discovery request by Friday, and the parties return to court Monday, Sept. 21. Read that calendar plainly: it is a schedule for producing documents, not for deciding the case. Whatever the communications show, Order #58 is the operative guideline for leases starting Oct. 1, and renewal offers going out now should be written at 0 percent.
