Wingate Realty cited over collapsed wall at 55-unit Bronx building

Wingate Realty got a Class 1 city violation on Sept. 23 for a partly collapsed rear-yard retaining wall at 2682 Bailey Avenue, a 55-unit Bronx building.

Wingate Realty LLC, the owner of a 55-unit, six-story apartment building at 2682 Bailey Avenue in the Bronx, was cited on Sept. 23 after a Department of Buildings inspector found a partially collapsed rear-yard retaining wall, according to the city’s ECB violation record 39205206H.

The violation is Class 1, the city’s most serious tier. It says a portion of the wall had been replaced by a wooden fence and that the remaining wall is cracked. The record carries a $12,500 penalty, all of it still due, with a hearing set for Dec. 4. The record does not show injuries, and we found no HPD vacate order for the building.

Why it matters

Retaining walls sit below the facade line, so they rarely draw the attention a fallen cornice does. But a failed wall is a structural repair with engineering, permit and shoring scope, the kind of work builders and contractors get called in on. The violation cites the city’s requirement to maintain building walls and appurtenances, and the owner has to file for repairs and correct the condition to clear it.

This is also a repeat pattern. The city’s ECB dataset lists 72 violations against Wingate Realty at this building’s tax record since June 2007, with $435,160 in penalties imposed and $154,793 still unpaid. Recent ones include a Class 1 construction violation in January and a Class 1 elevator violation in December 2025.

The numbers

City property data lists the 1960 building at 67,175 square feet across six floors and 55 residential units, owned by Wingate Realty LLC. The Sept. 23 penalty works out to about $227 per unit. The unpaid ECB balance across the building’s history is roughly $2,814 per unit.

What’s next

The Dec. 4 hearing is pending, and the violation stays active until the wall condition is corrected. Watch for a repair filing on the Department of Buildings portal, which would show who is hired to rebuild the wall. More New York distress and building-condition coverage is on the New York hub.
