East Flatbush Stair Collapse: 6 Units, 69 Open HPD Violations
The ECB penalty is $2,500 and unpaid, with a hearing Nov. 25. HPD shows 17 open Class C violations, the immediately hazardous kind.
On Sept. 18, a Department of Buildings inspector found part of the floor at the interior stair landing of 335 East 34th Street in East Flatbush collapsing into the cellar. The six-unit building’s owner, BH Flushing, LLC, was cited for failing to maintain it in a safe condition, and 69 housing violations are still open on the lot.
Why it matters
The people at stake are the residents of six apartments who use that stair. ECB violation 35721963K is a Class 1 construction violation, and the inspector wrote that the collapse created a hazard for the occupancy. DOB’s complaint log shows several complaints entered the same day, Sept. 18, all closed the next day, and one more entered Sept. 21 that is still active. The records show no vacate order.
The owner of record is BH Flushing, LLC, with a Great Neck, Long Island address on the citation. The public record names no developer or operator behind the LLC, and we do not name anyone beyond it. It is a landlord, not a builder, and it holds one NYC lot under that name in city lot data.
The numbers
HPD has 237 violations on the lot, and 69 are open: 9 Class A, 43 Class B and 17 Class C. Class C is the city’s immediately hazardous category. The oldest open one dates to an inspection in December 2014, before the current owner bought, and the newest to September 2025. DOB also lists four open boiler-filing violations, the earliest from 2006.
The ECB penalty is only $2,500, none of it paid, with a hearing set for Nov. 25 and the case still pending. By comparison, the deed in August 2015 moved the building from a foreclosure referee to BH Flushing for $635,000, about $105,800 per unit. A 30-year ACRIS pull shows no mortgage recorded since, so the building appears to be held without recorded debt.
What’s next
Watch the Nov. 25 hearing and any DOB order for the stair, plus whether HPD files a repair case against the open Class C items. If the penalty stays at $2,500 and the structure is not fixed, a vacate order is the escalation the record would show first.
