The Department of Buildings classed it Class 1, its most serious tier, with a $2,500 penalty imposed and the violation still active.
Why it matters
For contractors and builders on Brooklyn sites, the fence is a permitted, inspected item, not a formality. A Class 1 citation on a perimeter fence shows the department will write the top tier for site protection alone, before any structural failure in the building. Rogers is the respondent on this one, so a general contractor carries the exposure even where the owner of record is a different party.

The building sits under a DOB NOW filing, B00672000-I1, an alteration to enlarge an existing 3-story mixed-use building, with a stated initial cost of $1,211,070. The job lists Satmar Meat Market Inc as owner.
The Jan. 3, 2023 deed moved the lot from Park ARL LLC to 5001 Realty LLC for $1.9 million. Park ARL had paid $2.07 million in 2018.
