Brightline's MiamiCentral Retail Hit With Foreclosure Suit
U.S. Bank filed a foreclosure complaint and lis pendens against the retail component of Brightline's MiamiCentral station in downtown Miami, per Clerk records.
U.S. Bank Trust Company, National Association filed a commercial mortgage foreclosure complaint against the retail component of Brightline’s MiamiCentral station in downtown Miami on July 30, then recorded a lis pendens the next day, according to Miami-Dade County Clerk of Courts records. The case, No. 2026-015506-CA-01, names Brightline Investment Holdings LLC, Florida Investment Holdings LLC, DTS DT Retail LLC and FECI Realty LLC as defendants, along with several construction-lien claimants including Quality Railings Miami Corp and HB Construction LLC.
Why it matters
MiamiCentral is the single most-watched transit-oriented development in South Florida, the retail podium beneath Brightline’s own train hall. A foreclosure filing against that retail component, while the rail station itself sits under a separate ownership structure and continues operating, is a live test of whether ground-floor retail underwriting at TOD projects priced in enough cushion. Developers weighing retail-anchored podiums at future transit stops, and brokers marketing that space, now have a real docket to study rather than a rendering to sell against.
The numbers
The complaint was filed July 30 and the lis pendens recorded July 31, per the Clerk’s docket. The same day as the complaint, plaintiff’s counsel also filed a motion for assignment of rents and a motion for order to show cause, filings consistent with a push for a receiver over the retail unit’s income. A hearing on transferring the case to the Complex Business Litigation Section is set for August 26 before Judge Jason E. Dimitris. The Real Deal and WLRN both reported the lender is seeking roughly $65 million; that figure and the loan’s origination date appear in the complaint itself, which was not independently pulled for this story, so treat them as reported rather than record-confirmed here.
What’s next
The August 26 hearing will determine which division handles the case going forward, and any ruling on the assignment-of-rents motion will show quickly whether a receiver takes over leasing and collections at the retail podium. Miami-Dade Property Appraiser records show the adjacent rail parcel, folio 01-4137-072-0090 at 600 NW 1st Avenue, remains titled to Brightline Trains Florida LLC and centrally assessed as a railroad property, separate from the retail unit named in the suit. Watch for the underlying complaint to surface the exact loan terms and whether the tenant roster inside the podium holds through a contested foreclosure.
