3 Brooklyn owners hit with $45,000 for building under stop-work orders
Two owners built new one-story structures after full or partial stop-work orders. A third erected a metal-frame canopy.
Three Brooklyn property owners were cited between Oct. 5 and Oct. 7 for continuing to build while their buildings were under stop-work orders, and the city set penalties totaling $45,000, according to NYC Environmental Control Board records.
All three violations are Class 1, the most serious ECB class, under code section 28-207.2.2 for unlawfully continued work while on notice of a stop-work order. All three remain active with hearings pending.
Why it matters
A stop-work order is the Department of Buildings’ hardest brake on a job. Working through one exposes an owner to penalties that stack with the underlying violations, and it can complicate permits, lender draws and any later sale. For contractors, the practical risk is being the crew on site when an inspector arrives.
The numbers
- 2057 East 22nd Street: the respondent is Morris Cohen. A full stop-work order covering the entire building was issued June 8, 2026 (summons 3919676H). The inspector observed a newly built one-story structure. Violation 39206806X, issued Oct. 5, carries a $10,000 penalty and a Dec. 9 hearing.
- 2467 East 12th Street: the respondent is 2467 E12 LLC. A partial stop-work order on the entire building was issued July 15, 2026 (summons 39197758Z), and the inspector again recorded a newly built one-story structure. Violation 39207113H, issued Oct. 7, carries a $25,000 penalty and a Dec. 16 hearing.
- BIN 3196285 (block 7247, lot 245): the respondent is BH Shell Road LLC Investo, with a Short Hills, N.J. address. The inspector recorded a canopy with a metal frame and corrugated roof erected under notice of a stop-work order. Violation 39207160K was issued Oct. 5, served Oct. 7, with a $10,000 penalty and a Dec. 16 hearing.
No payments have been made on any of the three, per the records, and each shows a full balance due. Our earlier dossier listed the penalties as not yet imposed. The record now shows them, so the figures above come from the record.
What’s next
The hearings are set for Dec. 9 and Dec. 16, where each respondent can contest the charge. Penalties on a pending ECB case can change at hearing, so treat the $45,000 as the amount currently assessed, not a final judgment. Watch for DOB to lift or keep the underlying orders, which decides whether the newly built structures can be legalized or must come down.
