The San Jose City Council is set to hear a proposed first amendment to its development agreement with Apple Inc. covering the company’s North San Jose campus, under council file 26-1159, item 10.2 on the agenda for the Nov. 10, 2026 meeting. The item has not been voted on. It is pending the council’s action at that hearing. For developers and contractors in North San Jose, the companion street vacation, if approved, would change access and right of way around the Apple campus.
Why it matters
The parcels at issue sit on both sides of Atmel Way west of Orchard Parkway and both sides of Component Drive east of Orchard Parkway, assessor’s parcel numbers 101-03-004, 007 and 008, and 101-02-011, 016 and 017, according to the agenda. The proposal would modify the amended and restated development agreement Apple already holds with the city for that campus footprint. The staff recommendation asks the council to adopt a resolution approving a CEQA addendum and a related mitigation monitoring and reporting program. The addendum covers three prior reviews: the North San Jose Development Policies Program EIR, the Envision San Jose 2040 General Plan EIR and the BEA Development Project EIR. The council would then separately consider an ordinance enacting the amendment itself. Neither has happened yet.
The numbers
The agenda lists the matter in Council District 4 and ties it to file ER26-132 for the environmental review. It is scheduled to be heard concurrently with a second item, file 26-1152, which would conditionally vacate a segment of Orchard Parkway running from Orchard Place to Component Drive, and all of Orchard Place itself, formerly known as Atmel Way, reserving a public service easement over the vacated right of way, according to the agenda. That companion item cites the same trio of prior environmental reviews by resolution number: 72768, 76042 and 72169. The agenda does not list new square footage, unit counts or a construction timeline for the campus itself. For context on the pace of entitlement activity nearby, Seely Development’s 372-unit Trimble B permit cleared the city for $66 million in late October.
What’s next
The council is set to take up both items during the land use regular agenda portion of the Nov. 10 session, with the vacation item, 3.4, and the development agreement amendment, 10.2, heard together. Final approval of the ordinance amending the Apple agreement, and of the resolution vacating the street segment, remains pending the council’s vote that day. More detail on what the amendment itself would change, beyond the street vacation tied to it, sits in the full staff report attached to the agenda, which The American Developer will review once the item is heard.
