Alpha Insulation Sues Via Mizner Over $312K at Boca Raton's Tower 105
Palm Beach County's civil docket shows a fifth-figure sub payment fight layered on top of a nine-figure foreclosure at the same Boca Raton tower.
Alpha Insulation and Waterproofing has sued Via Mizner Owner III LLC over roughly $312,000 in allegedly unpaid work at Tower 105, the stalled Mandarin Oriental Residences project in downtown Boca Raton. The case, filed in Palm Beach County’s Fifteenth Judicial Circuit under case number 50-2026-CA-008418-XXXA-MB, adds a subcontractor payment dispute to a site already tied up in a much larger lender fight.
This is a different case from the $417.7 million foreclosure suit an Apollo-affiliated lender filed against the same Via Mizner Owner III LLC entity in July, which The American Developer covered separately. That case targets the construction loan on the whole 1.49-acre site. Alpha’s suit is a much smaller claim tied to work the insulation and waterproofing subcontractor says it performed and was not paid for.
Why it matters
For subs and GCs weighing whether to take on trade work at Tower 105, a payment lawsuit from a subcontractor is a direct signal about how this ownership entity settles its bills, independent of whatever happens in the foreclosure case. Alpha is a division of publicly traded Installed Building Products, a company with the resources to litigate rather than write off a bad receivable, which is itself informative about how seriously the claim is being pressed. A construction lien also clouds title, adding one more claim a lender or buyer has to clear before the site can trade or refinance cleanly.

Alpha’s complaint claims approximately $312,000 in unpaid work, allegations that have not been tested in court. That is a small fraction of the $417.7 million foreclosure claim already pending against Via Mizner Owner III LLC on the same 1.49-acre parcel at 105 East Camino Real, but it is real money for a specialty trade contractor and it puts a second creditor’s claim on the record against the same ownership entity.
