Cypress owner-finance home posted for Nov. 3 Harris trustee sale
A Harris County trustee notice sets a Nov. 3 sale on a Cypress home HCAD values at $344,522, with Dorwin Samuel The Owner Finance Company as trustee.
A Harris County Notice of Substitute Trustee’s Sale sets a Nov. 3, 2026 auction for 12623 Rifleman Trail in Cypress, a single-family home the Harris Central Appraisal District (HCAD) values at $344,522 for 2026. The notice, FRCL-2026-7658, filed Oct. 13, lists Dorwin Samuel The Owner Finance Company as trustee, which points to a seller-financed note rather than a bank mortgage.
Why it matters
Texas has no foreclosure lawsuit. A lender posts a notice with the county clerk at least 21 days ahead of a first-Tuesday sale, and that notice, not a court docket, is the public record. This one names an owner-finance operation, a niche that exists because a buyer could not qualify for a bank loan and instead signed a note directly with a seller carrying the paper.
That structure cuts both ways. Owner-finance sellers accept buyers banks will not, at rates that price in the added risk. When a buyer stops paying, the seller forecloses the same way any lender does, through a first-Tuesday trustee’s sale.
This notice sits outside our count of 53 company-owned Harris County properties posted for Nov. 3 sales. It is a reminder that the Harris County Clerk’s office keeps adding notices to the same sale date for weeks after any single snapshot.
The numbers
Our automated read of the notice PDF puts the original loan at $289,000. That figure has not yet been confirmed against the document and is reported here as unverified. HCAD account 1088020000003 carries a 2026 appraised value of $344,522 under state class A1, residential. If the loan figure holds, the gap between the two is roughly $55,000, which is why a sale posting by itself does not mean the lender expects to take the property back.
What’s next
Harris County trustee sales begin at 10 a.m. CT on Nov. 3. The borrower can still cure or refinance before then. If not, the property goes to auction, where the lender most often takes it back by credit bid when no outside bidder shows. More distress filings are tracked on the Houston market page.
