A Bronx property owner kept working after the city ordered him to stop, and now owes a $10,000 penalty he has not paid.

The Department of Buildings cited Rahim Md Abdur on October 14 for continuing construction at 3152 Decatur Avenue while a stop-work order was active, according to Environmental Control Board violation 39207800J. Inspectors found an illegal curb cut and a concrete paver job already finished at the front of the lot, with a car parked on the new pavement. City records list the respondent’s address as the same Decatur Avenue property. He is cited for the violation, which is classified Class 1, the most severe DOB tier. The case has not gone to a hearing and no determination of guilt has been made.

Why it matters

A stop-work order is the Department of Buildings’ hard stop on a job, and defying one is treated differently than an ordinary paperwork violation. The Class 1 classification here signals the city views continued work after a stop-work order as an immediate hazard, not a technicality. It is the same enforcement posture DOB used four days earlier against a Brooklyn owner cited for an almost identical pattern, continuing a porch build after a stop-work order at 905 Newkirk Avenue in Midwood. Two unrelated owners, two boroughs, the same decision to keep building rather than wait out a city order, and the same $10,000 opening penalty.

For other owners mid-permit, the record is a reminder that a stop-work order does not pause only the inspected work item. DOB’s violation description here covers finished curb-cut and paving work completed at the site after the order was on notice, which is the kind of exterior, easily-inspected work that tends to draw a follow-up citation fast.

The numbers

  • $10,000 penalty imposed, Class 1 severity, infraction code 112
  • $0 paid toward the balance, leaving the full $10,000 outstanding
  • Violation issued and served October 14, 2026
  • Hearing scheduled for December 18, 2026 at 9:30 a.m.
  • Cited under NYC Administrative Code 28-207.2.2, unlawfully continuing work on notice of a stop-work order
  • Site: BIN 2018538, Block 3353, Lot 21, Bronx

What’s next

The case moves to an Environmental Control Board hearing on December 18. Nothing has been paid toward the $10,000 balance as of this record, and the violation remains active with no determination yet entered. A hearing officer, not DOB’s inspectors, will decide whether the citation stands, is reduced, or is dismissed. Until then, Rahim Md Abdur remains cited, not found liable, and the stop-work order’s underlying permit status is unchanged by this record.
