The city fined Volk Industrial Services $5,000 on Oct. 5 after a worker fell from a third-floor scaffold at a demolition site at 1720 Sheepshead Bay Road in Brooklyn, according to Department of Buildings (ECB) violation 39560166Z.

Why it matters

The violation says inspectors responded to the incident at about 7:30 a.m. at an interior demolition jobsite and that the worker sustained a back injury. The text available in city data cuts off mid-sentence after stating that the general contractor failed to act. The cited code section, BC 3301.8, is failure to immediately notify the Department of an accident at construction.

So the fine is for the reporting failure, not for the fall itself. The record does not say whether a stop-work order followed, and DOB violation data for the building shows none; a complaint was entered for the address on Oct. 5 and is marked closed.

The numbers

The violation is Class 1, the most serious ECB class, with $5,000 imposed, nothing paid and a hearing set for Dec. 9 at 8:30 a.m. The respondent is Volk Industrial Services, with a Ridgewood, N.J., address.

The building is a 1927, three-story, 37,363-square-foot structure on a 24,214-square-foot lot zoned R4, per city tax records, with no residential units. The demolition filing names Rybak Development Corp as owner, covers floors 1 through 3, and carries an initial cost of $450,000. A scaffold filing for the job was permitted to Skyline Scaffolding Group in September.

Tax records list a different owner, Cesco Management LLC, and we could not reconcile the two names. Our ACRIS search by lot returned no recorded documents in range, so we cannot say when either entity acquired the property or for how much. DOB NOW shows no new-building filing for the lot, so what replaces the building is not on record.

What’s next
