Valid petition opposes DB90 density bonus on S Capital of Texas Hwy
One case drew a valid petition in opposition. The other drew none. The city has not posted what Council did.
A valid petition in opposition is on file against C14-2025-0089, a request to add density bonus 90 (DB90) zoning to four addresses from 1120 to 1220 S Capital of Texas Hwy SB. That case and C14-2026-0008, the 1900 Rosewood Block in East Austin, were on Austin City Council’s Oct. 8, 2026 agenda. The city has not yet posted what Council did.
Why it matters
DB90 is the district suffix Austin uses for its density bonus program, where an owner asks for more height and units on a tract in return for affordable housing. Each rezoning is a test of how that rule works on a real site. For a developer, builder or agent pricing a parcel nearby, the outcome sets what a neighbor was allowed to ask for.
The two cases drew different reactions. C14-2025-0089 covers 1120, 1120 1/2, 1122 and 1220 S Capital of Texas Hwy SB in the Eanes Creek Watershed. Its agenda text says a valid petition has been filed in opposition. C14-2026-0008, the 1900 Rosewood Block, carries no petition language.
The numbers
- C14-2025-0089, Legistar item 29, file 26-2660 (record): rezone from LO and LR to LR-V-CO-DB90 (neighborhood commercial, vertical mixed use building, conditional overlay, DB90). The owner and applicant is AREIT City View LLC, with Drenner Group, P.C. as agent. Staff and the Zoning and Platting Commission recommended grant. A valid petition in opposition is on file.
- C14-2026-0008, Legistar item 31, file 26-2699 (record): rezone 1155 Chicon St, 1900, 1902, 1904 and 1906 Rosewood Ave and 1152 Poquito St in the Boggy Creek Watershed from CS-MU-V-CO-NP to CS-MU-V-CO-DB90-NP. The owners and applicants are 2019 Bagels, LP and Poquito Chicon, LP, with Armbrust & Brown, PLLC as agent. Staff and the Planning Commission recommended grant.
- Result: none posted. The Oct. 8 meeting page says minutes are not finalized and actions are not available as of Oct. 13, 2026.
The agenda text we checked does not state unit counts, and it does not state a vote threshold for the petition. We do not report either. A commission vote is a recommendation. Only Council decides.
What’s next
Once the city finalizes the Oct. 8 minutes, the Legistar item pages should show the action on each case: approved, postponed, or a first-reading vote. We will update when the record posts. Until then, treat both as pending, not decided.
For the next docket, see our coverage of the Oct. 22 rezonings at 6th St and Dalton Lane and the rest of our Austin market coverage.
